Pursuant to the Delta Protection Act(Act), approvals for <br /> projects in the Primary Zone shall take into consideration consistency with the provisions of the Land <br /> Use and Resource Management Plan for the Primary Zone of the Delta(Management Plan). <br /> The Act was passed into law in 1992 in recognition of the increasing threats to the resources of the <br /> Primary Zone from urban and suburban encroachment having the potential to impact agriculture, <br /> wildlife habitat, and recreation uses. Pursuant to the Act,the Management Plan was completed and <br /> adopted by the Commission in 1995. It sets out findings,policies, and recommendations resulting <br /> from background studies in the areas of environment, utilities and infrastructure, land use, <br /> agriculture, water, recreation and access, levees, and marine patrol/boater education/safety programs. <br /> As mandated by the Act,the findings,policies and recommendations provided in the Management <br /> PIan are incorporated into the General Plans of local entities having regulatory authority within the <br /> Primary Zone. This mandatory inclusion of the Management Plan in local government General Plans <br /> and zoning regulations, including those of San Joaquin County, requires that the findings, policies <br /> and recommendations be considered in actions taken on land use activities involving the Primary <br /> Zone. Thus, the Commission serves as an appeal body in the event the actions of a local entity on a <br /> project within the Primary Zone are challenged as being inconsistent with the Act or the Management <br /> Plan. <br /> Based on the information provided to the Commission, it appears that there is the potential for <br /> activities relative to the proposed project to impact the resources of the Primary Zone. The <br /> findings and recommendations from the Management Plan that are most applicable to this <br /> project include, but are not limited to: <br /> Utilities and Infrastructure <br /> ■ Policy 2: New houses built in the Delta agricultural areas shall continue to be served by <br /> independent potable water and wastewater treatment facilities. Uses which attract a substantial <br /> number of people to one area, including any expansions to the Delta communities, recreational <br /> facilities or businesses, shall provided adequate infrastructure improvements or pay to expand <br /> existing facilities, and not overburden the existing limited community resources. <br />
