sw� <br /> Per minor subdivision application No. PA-0600114 <br /> Public Works Recommendation#3 dated June 15, 2006 <br /> Recommendation# 3 —"Lauffer Road shall be dedicated and improved to County <br /> Standards for a fifty (50)foot right of way rural street prior to issuance of any <br /> building permit. Dedication shall be made by a separate instrument. A notice of <br /> subdivision restriction shall be recorded which details the dedication& <br /> improvement requirements prior to approval of the certificate of compliance." <br /> 1. Description of the proposed Revisions: <br /> We are requesting to be relieved of installing asphalt paving on Lauffer Road and <br /> further request Public Works re-evaluate the alignment and location of the right of <br /> way on Lauffer Road. The approval of this minor subdivision is in itself <br /> justification to customize the location and alignment of Lauffer Road. We request <br /> that Public Works evaluate this condition as shown on the attached schematic <br /> plan. <br /> 2. State the facts showing the changes,in circumstances which make the subject <br /> condition on longer gra riate or necess <br /> This land is vested in the Towne Family Trust and the minor subdivision has been <br /> requested in order for it to conform to their estate planning. This property has put <br /> a heavy financial burden on the Towne Family and under its present condition it is <br /> not sustainable for agricultural use. The parcelization needs to be done for <br /> financial purposes. The burden that the Townes are facing is that approximately <br /> 265 acres of vineyards were infected with blight/fungus and had to be removed. <br /> The replacement costs will be approximately $15,000.00 per acre. The Public <br /> Works condition of installing a 32 foot wide asphalt pavement for approximately <br /> 7,000 linear feet of Lauffer Road services only the Townes and one other property <br /> owner. It is not in the best interest of the Townes or the county to require these <br /> improvements. Towne Enterprises includes 30 family members and will lease the <br /> whole ranch as a unit. This would give the Townes the flexibility of placing <br /> separate loans on the S individual parcels and giving the opportunity to make this <br /> property a sustainable agricultural use. The cost of developing the road is <br /> estimated in the range of$700,000.00 to $1,000,000.00 depending on the detail <br /> requirements of Public Works. This kind of cost would jeopardize the Townes <br /> ability to sustain their property in an agricultural use. We therefore request a <br /> review of the feasibility of the location of the Lauffer Road improvements. With <br /> the approval of this subdivision it should be reviewed and re-evaluated by the <br /> county policy makers and hopefully we can reach a more equitable solution for <br /> the Townes and at the same time satisfy county requirements. <br />
