J RECEIVED
San Joaquin Valley SEP 2 3 2005
Air Pollution Control District C0mmL117/tyDeve10
pment Dept
September 22, 2005 Reference No. 0200501137
Kathy Allen
San Joaquin County
Community Development Dept.
Development Services Div.
1810 E. Hazelton Ave.
Stockton, CA 95205
Subject: PA-0500554 (Lowell Rathe)
Dear Ms.Allen:
The San Joaquin Valley Unified Air Pollution Control District (District) has reviewed the project referenced
above and we suggest that a Negative Declaration would be appropriate in addressing only air quality
related issues. The entire San Joaquin Valley Air Basin is designated non-attainment for ozone and
particulate matter (PM10 and PM2.5). Preliminary analysis indicates that this project alone would not
generate significant air emissions. However, the increase in emissions from this project, and others like it,
cumulatively reduce the air quality in the San Joaquin Valley. A concerted effort should be'made to
reduce project-related emissions as outlined below:
The Application Referral should have included more precise detail of the project, specifically, a more
detailed description of the driveway and parking area and further explanation of type of equipment sales
and repair will occur at the facility. Based on the information provided, the proposed project will be subject
to the following District rules. This project may be subject to additional District rules and regulations. To
identify additional rules and regulation that may apply to this project, or for further information,
the applicant is strongly encouraged to contact the District's Small Business Assistance Office at
(209) 557-6446. Current District rules can be found at http://www.vallevair.orglrules/1 ruleslist.htm.
The following items are rules that have been adopted by the District .o reduce emissions throughout tile
San Joaquin Valley, and are required. The County of San Joaquin should be aware that District rules are
not considered mitigation, which is optional, but instead are requirements that must be applied.
Regulation VIII (Fugitive PM10 Prohibitions) Regulation VIII (Rules 8011-8081) is a series of rules
designed to reduce PM10 emissions (predominantly dust/dirt) generated by human activity, including
construction, road construction, bulk materials storage, landfill operations, etc.
Rule 8021 If a non-residential site is 1.0 to less than 5.0 acres, an owner/operator must provide
written notification to the District at least 48 hours prior to his/her intent to begin any earthmoving
activities as specified in Section 6.4.2. The District's Compliance Assistance Bulletin for construction
sites can be found at: http://www.vallevair.org[busind/complvPM10/Req%20VIII°/u20CAB.pdf. Also, a
template of the District's Dust Control Plan is available at: http://www.vallevair.org/busind/
comply/PM 10/forms/DC P-Form'/u20--%2010-14-2004.pdf.
Rule 8051 (Open Areas) applies to any open area having 0.5 acres or more within urban areas, or
3.0 acres or more within rural areas; and contains at least 1,000 square feet of disturbed surface
area.
