Analysis <br /> Background <br /> On October 5, 2005, the Community Development Department approved Site Approval application <br /> No. PA-0500468 for a small winery with a multipurpose winery building including a tasting room, office, <br /> warming kitchen, and storage room. (Use Type:Wineries and Wine Cellars-Winery, Small) Although a <br /> marketing plan was submitted proposing one marketing event per year, the marketing plan was not <br /> incorporated into the Conditions of Approval and, as a result, the winery was approved without marketing <br /> events. Improvements were constructed and the winery was established. <br /> Marketing Events <br /> If the project is approved, there will be thirty-six marketing events per year. The applicant anticipates a <br /> maximum attendance of 100 people per marketing event and the marketing events will operate between <br /> 12:00 p.m. and 10:00 p.m. The winery ordinance permits marketing events as an accessory use to a <br /> winery (Development Title Section 9-1075.3(m)). Marketing events shall end by 10:00 p.m. pursuant to <br /> Development Title Section 9-1075.3(m)(2). The project complies with the winery ordinance contained in <br /> the Development Title. Development Title Section 9-1075.1 states "The intent of the Wineries and Related <br /> Facilities Chapter of the Development Title is to establish regulations that will acknowledge the distinctive pairing <br /> of wine grape growing, wine making, and tourism. The challenge is to provide for agricultural tourism and <br /> marketing activities while ensuring that agricultural resources remain vital. A major purpose is to guarantee that <br /> both winery and wine cellar marketing events are accessory and are subordinate to the primary agricultural use". <br /> Marketing events can take many forms, but they all must promote wine and have wine from the <br /> associated vineyard for sale. The applicant has indicated the marketing events are specifically geared to <br /> sell their wine. Marketing event overflow parking spaces will be contained on-site. <br /> Neighborhood Opposition <br /> The Community Development Department has received one letter of opposition from a neighbor. The <br /> letter of opposition from the neighbor expressed concern regarding the project's impacts on noise and <br /> traffic. <br /> Noise: The neighbor in opposition expressed concern regarding the project's noise impacts to <br /> surrounding parcels and indicated events had already occurred at the site with loud music. The neighbor <br /> in opposition is located approximately 780 feet east of the project site. Pursuant to Development Title <br /> Section 9-1025.9(a)(1), a residential use is a noise sensitive land use. The nearest residence is located <br /> approximately 130 feet west of the project site. Events must comply with Development Title Section 9- <br /> 1025.9 regarding stationary noise standards (50 dB Hourly Equivalent Sound Level daytime, 45 dB <br /> Hourly Equivalent Sound Level nighttime, 70 dB maximum sound daytime, 65 dB maximum sound <br /> nighttime). The applicant has indicated there will not be amplified sound either indoors or outdoors at the <br /> events. If the applicant decides to propose amplified sound for events in the future, then the applicant <br /> would need to apply for a Revision of Approved Actions Application and a noise study will be required to <br /> ascertain noise impacts to noise sensitive land uses. The marketing events will primarily be contained <br /> indoors and therefore, any impacts from this project on surrounding noise sensitive land uses are <br /> expected to be less than significant. <br /> Traffic: The neighbor expressed concern regarding the project's impacts on traffic and indicated <br /> attendees of events at the subject parcel have parked along Linne Road. The applicant has indicated <br /> there will be a maximum attendance of 100 people at the marketing events and therefore, is able to <br /> provide the minimum required number of parking spaces on-site.
