LOCKE <br /> ROAD, LOCKEFORD) <br /> The applicants are proposing to use 5,820 square feet of an existing 12,000 square foot <br /> warehouse to store carpet and padding materials (Use Type: Wholesale Distribution- <br /> Light). The remainder of the building will be used as an apartment and personal storage <br /> area. There will be no on-site retail sales because the carpet business currently has a <br /> show room and sales office within the City of Lodi. The 3.07 acre parcel is located on <br /> the north side of Locke Road, 1600 feet west of State Route 12/88, in Lockeford. The <br /> site has a General Plan designation of RNL (Residential-Very Low Density) and is <br /> zoned R-VL. <br /> History <br /> When the previous owner purchased the property in 1983 through a bankruptcy <br /> proceeding, an equestrian equipment sales business was operating on site without the <br /> benefit of permits. The previous owner did not realize that the business was operating <br /> without the necessary permits, or that the site did not have the correct zoning to operate <br /> and equestrian equipment sales business. He proceeded to request that the Planning <br /> Commission recognize his use as non-conforming based on the historical background of <br /> the site. On July 2, 1987, the Planning Commission determined that the site could <br /> continue to sell equestrian equipment and manufactured prefabricated buildings as a <br /> legal non-conforming use based on the evidence submitted by the owner. A motion was <br /> made and approved by the majority of the Planning Commission. According to <br /> Development Title Section 9-110.4, a "nonconforming use' is defined as a use which <br /> was legal when brought into existence but which does not conform to the current uses <br /> allowed or to the performance standards of the zone where it is located. <br /> As accessory to the equestrian equipment sales use the previous occupant began to <br /> process and package wood by-products for wholesale distribution.
