I feet this business is in-line with area and am glad that staff is progressing <br /> on getting an acceptable permit for this plan. Many of the items of concerns in the report are in-line with my mine so in the <br /> present form, most of my concerns have be addressed. <br /> After reviewing the staff.report, I have three concerns. The first is that the plan is in two stages that are spaced 5 years apart <br /> Since there is present activity which was done outside the permit process, It would seem prudent the second stage of the permit <br /> conditional upon review of the first stage prior to releasing the permit for the second stage. An example of a condition for release <br /> would be verification that all aspects contained in the staff report, have been adhered to. <br /> The second concern is that present signage is on my property which has been addressed in the staff report. There is no <br /> agreement concerning this sign, it is not permitted, and should be addressed immediately. <br /> The third and final concern is the present access from Louise Avenue is not acceptable and a right of way agreement is not in <br /> place. The Staff report indicates the existing driveway encroaches on the neighboring parcel to the East, this is not true. The <br /> existing driveway encroaches onto the parcel to the West,which I own. I received a written request on March 29th for my review <br /> for a right of way. Unfortunately,this request is unacceptable for several reasons, one of which is requests permission to operate <br /> outside the times specified in Project Description of the staff report In talking with Danny, I specifically mentioned weekend <br /> operation as a concern in addition to after hours. I am concerned that Danny cannot control traffic to the acceptable times of <br /> day and to the specified days of the week contained in the staff report Danny indicated to me that he cannot control the traffic. <br /> also discussed with Danny details available on the alternatives to the present Louise Avenue access. Danny indicated one <br /> option would be to route traffic in a one way direction from Louise Avenue into his operation and exit onto Wagner road. My <br /> concern is addressed in the staff report, that this solution will require an agreement in order to secure the additional 4 foot right of <br /> way. <br /> respectfully submit these concerns for review.
