r <br /> Verizon routinely reviews proposed antenna facilities for compliance with the Federal <br /> Communications Commissions ("FCC's') environmental protection ("NEPA") rules set <br /> forth at 47 C.F.R. Sections 1.1301 to 1.1319. In those cases where Verizon performs a <br /> NEPA review and discovers that the proposed construction would pose a significant <br /> environmental impact to any environmental sensitivity governed by the NEPA rules, <br /> Verizon's policy is to consult the appropriate environmental agency, and if necessary, <br /> file an environmental assessment with the FCC. Upon grant of the environmental <br /> assessment, and upon grant of the zoning application and any other required <br /> approvals;Verizon will proceed with the construction of the antenna facility. <br /> HEALTH EFFECTS <br /> The proposed Verizon facility falls within all state and federal regulations for emissions <br /> of non-ionized radiation emissions. <br /> The 1996 Federal Telecommunications Act prohibits local jurisdictions from denying a <br /> wireless telecommunications facility on the basis of Radio Frequency Radiation (RF) <br /> emissions, so long as such facilities meet or exceed the FCC's standards for such <br /> emissions. While the Telecommunications Act prohibits local jurisdictions from <br /> imposing more stringent standards than those accepted by the FCC, it does not <br /> preclude local jurisdictions from requiring a finding of compliance. <br /> FAA REGULATIONS <br /> Federal Aviation Administration (FAA) rules require that the location and height of <br /> proposed facilities be reviewed by the FAA to prevent interference with the operations <br /> of nearby airports. The FAA has jurisdiction over proposed facilities that exceed 200 <br /> feet in height, as well as smaller towers and facilities located within 20,000 feet of a <br /> major airport (serving commercial and/or military aircraft) and 10,000 feet of a general <br /> aviation airport (serving small aircraft). Verizon Wireless will be in full compliance <br /> with all FAA requirements. <br /> COLLOCATION <br /> Verizon will work with any carriers who wish to collocate at this site. Our lease does <br /> not prohibit any carriers from locating on this parcel or monopole. <br />
