The owner shall execute an Irrevocable Offer and Agreement to Dedicate Road to result in a <br /> fifty-six (56) foot wide right-of-way from the centerline of Lower Sacramento Road to the <br /> property across the parcel's frontage. (A $280.00 fee currently is required for processing per <br /> Development Title Table 9-240.2 in addition to a copy of the Grant Deed.) <br /> (Development Title Section 9-1150.5) <br /> 4. The frontage improvements for 10702 Lower Sacramento Road shall be constructed in <br /> conformance with the standards for one-half of a 120-foot right-of-way Major Arterial - <br /> Expressway. The construction of the frontage improvements will be deferred upon execution <br /> by the owner of a Deferred Frontage and Roadway Improvement Agreement or a Secured <br /> Deferred Frontage and Roadway Improvement Agreement with a deposit equivalent to their <br /> estimated construction costs prior to approval of the Improvement Plan. (A $325.00 fee <br /> currently is required for processing per Development Title Table 9-240.2 in addition to a copy of <br /> the Grant Deed and an estimate for the required frontage improvements. The estimate shall <br /> be prepared by a Registered Civil Engineer with a typical section drawing on a form to be <br /> supplied by the Department of Public Works and submitted to the Department of Public Works <br /> for approval. As an option, the Department of Public Works will prepare the drawing and <br /> estimate for an additional fee of $140.00.) <br /> (Development Title Section 9-1150.2) <br /> 5. The Traffic Impact Mitigation Fee will be required for this development. The fee is due and <br /> payable at the time of building permit application. (The fee currently is $174.59 per daily <br /> trip-end generated in the Stockton area. The fee shall be automatically adjusted July 1 of <br /> each year by the Engineering Construction Cost Index as published by the Engineering News <br /> Record. A credit may be allowed if it can be verified that the existing development on this site <br /> was in operation on or after April 23, 1990.) <br /> (Resolutions R-90-304, R-91-1025, R-93-167, R-94-1791 R-95-650, and R-96-592) <br /> 6. The Water Supply Facilities Impact Mitigation Fee will be required for this development. The <br /> fee is due and payable prior to issuance of the building permit. The fee currently is $403.00 <br /> per 1,000 gross square foot of building as Commercial Service. The fee shall be automatically <br /> increased on January 1 of each year through the year 2005 at the rate of 7.66 percent. A <br /> credit may be allowed if it can be verified that the existing development on this site was in <br /> operation on or after April 30, 1991. <br /> (Development Title Section 9-818.4 and Resolutions R-91-327, R-94-185, and R-97-5) <br /> 7. A copy of the Final Site Plan shall be submitted prior to release of building permit. <br /> 8. Verification shall be obtained from the Solid Waste Division (468-3066) that this development <br /> has addressed the items on the attached Waste Plan Format for Development Projects. Final <br /> Site Plan is required upon submittal of verification. <br /> 9. A traffic study is required for this development.
