Hazelton Ave <br /> Stockton, CA 95205 <br /> Dear Ms. Aguirre: <br /> PA-1500048; NEGATIVE DECLARATION - NINE PARCEL SUBDIVISION AND A DESIGNATED <br /> REMAINDER, RESTRICTED BY LAND CONSERVATION CONTRACT NO. 71-C1-0415 <br /> The Department of Conservation's (Department) Division of Land Resource Protection <br /> (Division) monitors farmland conversion on a statewide basis and administers the California <br /> Land Conservation (Williamson) Act and other agricultural land conservation programs. The <br /> Division has reviewed the above referenced project and offers the following comments and <br /> recommendations. <br /> PROJECT DESCRIPTION <br /> The project requests the subdivision of two parcels (totaling 203 acres) into nine new parcels <br /> and a designated remainder parcel. Each new parcel will contain 20+ acres of land. Currently <br /> both parcels proposed for the subdivision are enrolled in a Land Conservation Contract (No. 71- <br /> C1-0415). The County has stated that they believe 20 acres is large enough to sustain <br /> agricultural viability for each proposed parcel. <br /> The parcels are located on the northeast corner of the intersection of Lower Sacramento Road <br /> and Woodbridge Road, in the community of Acampo, in San Joaquin County. The property is <br /> classified Prime Farmland with some Farmland of Statewide Importance. <br /> SUBDIVISION OF PARCEL(S) IN LAND CONSERVATION ACT CONTRACT <br /> In order to approve subdivisions of Williamson Act contracted land, the local government <br /> administering the agricultural preserve must have a substantive basis for approving the <br /> application and map. It must do so on the basis of a specific affirmative determination <br /> that each of the resulting parcels is large enough to sustain the agricultural uses to <br /> which it is restricted and it must make a finding that the subdivision will not result in <br /> residential development of the resulting parcels, except where residential use will be <br /> incidental to the commercial agricultural use of the land. <br />
