Your letters describe an alternative to land application of winery wastewater generated in the <br /> Housley Winery to be constructed in Acampo, California. Housley Winery will contain all winery <br /> wastewater, store it on-site temporarily, and dispose of the wastewater at the Lodi municipal wastewater <br /> treatment plant. Solid waste including pomice, filter press, and other materials will be hauled off-site for <br /> recycling or will be landfilled. Domestic wastewater will be discharged to a septic tank and leachfield <br /> under the oversight of the San Joaquin County Environmental Health Department. Stormwater will be <br /> discharged to the adjacent vineyard. <br /> Previous to your decision to haul all wastewater off-site, Housley Winery submitted a Report of Waste <br /> Discharge. Tentative Waste Discharge Requirements (WDRs) were prepared and distributed on 26 June <br /> 2000. Because of the monitoring and discharge restrictions included in the WDRs, you elected to pursue <br /> the storage and off-site disposal option. <br /> Since Housley Winery will not be discharging any winery wastewater to a wastewater pond or land <br /> application area, then WDRs are not required. You are reminded that discharge of winery wastewater to <br /> land without WDRs or an authorized waiver is a violation of the California Water Code and exposes the <br /> discharger to enforcement, including administrative civil liability. <br /> The determination that WDRs are not required is contingent upon the submittal of an annual report <br /> documenting the wastewater disposal. Pursuant to California Water Code Section 13267, annual <br /> reports shall be submitted by 31 January of each year. The documentation shall be sufficient to <br /> determine the volume of wastewater produced, the method of storage, and the location of the disposal. <br /> Failure to submit the required reports may result in an administrative civil liability of$1,000 per day of <br /> violation.
