These waters are regulated under Section 404 ofthe Clean Water Act since they are tributary and adjacent to a tributary to Dry Creek, a water of the United States, in accordance with 33 CFR 328.3 (a)(7). A. prior Department of the Army permit is required for activities which involve any discharges of dredged or fill material into these waters. The C.01-acre seasonal wetland identified as SW-2 on the above drawing is an intrastate isolated water with no apparent interstate or foreign commerce connection.
