Analysis
Background
This application was submitted prior to adoption of the Wireless Telecommunications Facilities Ordinance.
As a result, the item was scheduled for a public hearing, with the understanding that if the Ordinance was
approved by the Board of Supervisors, the item would be taken off the agenda and acted upon at the staff
level, unless the item became controversial. One letter, requesting copies of the Planning Commission's
action and environmental determination was received, so the project has been left on the public hearing
calendar. The proposed project is consistent with the provisions contained in the Wireless
Telecommunication Facilities ordinance.
Zoning
On May 25, 1997, the San Joaquin County Board of Supervisors approved Development Title Text
Amendment No. TA-97-1, which added the Wireless Telecommunications Facilities to the Development
Title and grouped all commercial activities that provide electronic communication of information and
entertainment to the public under the Communication Services use type. Under the new requirements,
the proposed 70-foot-high wireless services tower would be classified as a "Communication Services -
Type IP use type, which may be conditionally permitted in the C-C zone with an approved Site Approval
application. Wireless services are regulated by the Wireless Bureau of the Federal Communications
Commission (FCC).
San Joaquin County SA-97-27/Schmidt
Community Development Page 5
