MS-91-28 <br /> On 4 October 1989 I wrote to Mr. James Miller, San Joaquin Public Health Service, <br /> in regards to Variance Application No. 90-1 . A copy of that letter is enclosed <br /> for your reference. <br /> The same factors involving wastewater management still apply. <br /> is divided, the applicant needs to show availability of enouIf the property <br /> gh cropland to <br /> adequately assimilate the waste stream from the poultry operation. <br /> Inspections and complaint investigations have revealed discharges of poultry <br /> wastewater from vineyards under control of the operator into Avena Drain. <br /> Therefore, the facility has not been operated in compliance with water quality <br /> regulations on the acreage that is presently available. A copy of the applicable <br /> regulations is enclosed for your reference. <br /> Any reduction in the acreage available for wastewater distribution or any further <br /> violations of the regulations will result in a request for a Report of Waste <br /> Discharge (RWD) and a $2,000 filing fee. Information in the RWD will be used to <br /> formulate Waste Discharge Requirements (WDRs) for the facility. Any violation <br /> of the WDRs is subject to enforcement action. <br /> In summary, I don 't believe that it is advisable to divide the cropland <br /> associated with the poultry operation unless the operator can clearly demonstrate <br /> that the disposal of poultry wastewater can be done in compliance with water <br /> quality regulations. <br /> Please advise us of the action taken on the subject application so that we may <br /> take any necessary regulatory action.
