Other Business: A. Consider scheduling Site Approval No. SA-95-47 of Terry Remitz, for farm equipment sales and hay sales at 21200 S. Paradise Avenue, Tracy (east side of Paradise Avenue,4000 feet north of Grant Line Road), for a public hearing for the purpose of revoking the permit or taking any other action deemed appropriate by the Planning Commission Tom Gau, Senior Civil Engineer, introduced the staff report into the record. The primary issue is the selling of cargo container trailers. This is leisure equipmentand is not farm machinery. Commissioner Morri said he received a lot of calls from people in the Tracy area about this matter. Selling these horse trailers is in violation of the approved project, in addition to the site having too many signs out there. Also, there is no landscaping strip. Commissioner Carter mentioned the issue of the difficulty of getting to the site. Tom Gau said Paradise Road is a minor road and not a collector road. This project was denied by staff and the Planning Commission because they could not make the findings. The Board of Supervisors approved the project with the condition that the road be widened and paved. Don Moyer(P. O. Box 207, Ripon), representing the property owner, said that they are selling farm related trailers to the farm community. Eighty to 85 percent of his sales are to farmers, including cargo trailers. Farmers use cargo trailers for storing seed, dry fertilizer, grain, dry chemicals, and various types of machinery. These types of uses are common for farmers. In regard to the landscaping strip, Paradise Road makes an incline as it approaches the overpass. The conditions state that the landscaping need not be installed along the Paradise Road frontage south of that incline. He does have landscaping with low lying bushes and an irrigation line in place along the entire 205 frontage of the property. He said he has a letter from Chet Davisson to DMV which states that the sale of horse trailers is allowed at this site. Commissioner Morn said that farmers do not use cargo containers. This is just for people coming into the area. He said it doesn't matter who signed the letter. That use is not allowed. MOTION: It was moved, seconded (Morri/Carter), and passed by a unanimous roll call vote to set Site Approval No. SA-95-47 for public hearing on March 4, 1999.
