SA-95-47 OF TERRY REMITZ <br /> FOR FARM MACHINERY SALES AND HAY SALES LOCATED <br /> AT 21200 S. PARADISE AVENUE, TRACY <br /> At the request of Commissioner Stan Mom, a report was prepared regarding the status of Site <br /> Approval Application No. SA-95-47 and the current uses on the property. A copy of this report <br /> and the conditions of approval are attached for your information. The primary issues are the <br /> existing uses on the property and whether the project is in compliance with the Conditions of <br /> Approval. <br /> This project was approved on appeal by the Board of Supervisors for Equipment Sales and <br /> Repair- Farm Machinery Sales and hay sales. Farm Machinery Sales is for the sale, rental <br /> and minor incidental repair farm machinery. Currently cargo container trailers are being sold <br /> on the premises which would fall under the Use Classification of Equipment Sales and Repair- <br /> Leisure, which is not permitted in any of the Agricultural zones. Other issues include the <br /> number of signs, landscaping and building permit requirements <br /> After reviewing the attached report, Commissioner Mom requested this matter be placed on an <br /> agenda of the Planning Commission, to,consider setting a public hearing to determine if the <br /> current uses and status of the property are in compliance with the terms of the approved <br /> permit and local ordinance. If the Planning Commission decides to set a public hearing, <br /> Development Title Chapter 9-230 provides that if any of the conditions of approval upon which <br /> the development approval was granted has been violated, the Planning Commission may, <br /> based on the evidence presented at the hearing, make findings and take an action to revoke <br /> or modify the development application.
