From the field review and comparison with the Condition of Approval the following issues are <br /> identified: <br /> • Condition 1b states that the approved use is for Farm Machinery Sales and hay sales <br /> and that Phase IV shall be completed prior to April 14, 1999. The application proposed <br /> that the use be developed in four phases as follows: <br /> Phase I office. <br /> Phase II to open covered parking spaces. <br /> Phase III the hay bam. <br /> Phase IV is for the shop and parking. <br /> Building permits have been obtained and finaled for the commercial coach, three cargo <br /> containers and the hay and farm machinery storage structure. The field review <br /> indicates that there may be one additional cargo container that did not have a building <br /> permit; and, some type of shop or repair work is being done outdoors. <br /> The Use Classification Systems defines Equipment Sales and Repair as the sale rental <br /> servicing and repair farm machinery, heavy equipment, aircraft and the variety of <br /> leisure oriented equipment. This classification is further broken down into Farm <br /> Machinery Sales and Farm Machinery Repair. Farm Machinery Sales is for the sale <br /> rental and minor incidental repair farm machinery. Typical uses would include tractor <br /> sales yards. Farm Machine Repair is for the repair of farm implements and equipment. <br /> Typical uses included welding shops and tractor repair shops. From these definitions, <br /> the sale of cargo trailers, would fall under the use classification of Equipment Sales and <br /> Repair-Leisure, which is not permitted In any of the Agricultural zones. The cargo <br /> trailers that are being sold are typically used by contractors for storing and transporting <br /> tools and equipment. <br /> • Condition 1g requires a 10' landscape strip across the frontage of Paradise Avenue and <br /> along State Route 205. From photographs at the site it does not appear the landscaping <br /> has been installed. <br /> • Condition 1j permitted a maximum of two advertising signs, only one of which may be a <br /> free standing sign. One free standing sign was approved with a Building Permit, however, <br /> there are free standing signs for each of the two entrances, including flags, as well as a <br /> number of other signs that are hung on fences. Other than the one permitted signs. All of <br /> the signs appear to be in violation of the permit. <br /> • Condition 2e requires that Paradise Avenue be widened to a collector road standards with <br /> 40' of pavement across the project frontage. I have confirmed with Public Works that the <br /> road was widened to forty feet of pavement for a length of 60 feet plus tapers at the project <br /> entrance. <br /> I hope this information adequately responds to your inquiry.
