CONDITIONS OF APPROVAL <br /> PA-0700593 <br /> Cotta Properties <br /> Minor Subdivision Application No. PA-0700593 was approved by the San Joaquin County <br /> Community Development Department on August 5, 2008. The effective date of approval is August <br /> 15, 2008. This tentative map approval will expire on August which <br /> c s three <br /> complied years and (2) e <br /> effective date of approval, unless (1) all Conditions of Approval have been <br /> Parcel Map has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified, and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Patrick Crosby, [209)468-8597) <br /> a. TENTATIVE MAP: The Parcel Map shall substantially conform to the approved tentative map dated <br /> April 10, 2008. <br /> b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note <br /> shall be placed on the Parcel Map: <br /> (1) All persons purchasing lots within the boundaries of this approved map should be prepared to <br /> accept the inconveniences or discomforts associated with agricultural operations or activities, <br /> such as noise, odors, insects, dust or fumes. San Joaquin County has determined that such <br /> inconveniencies or discomforts shall not be considered to be a nuisance. <br /> c. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) All parcels shall have a minimum lot width of 330 feet, measured at the front yard setback line. <br /> (Development Title Section 9-610.4) <br /> (2) All parcels shall have a minimum lot area of 40 acres. (Development Title Section 9-610.2) <br /> d. TREE PRESERVATION: Future development on the parcel(s) shall be consistent with the <br /> requirements of the County's Tree Preservation Ordinance (Development Title Section 9-1505.2). <br /> (1) The following note shall be placed on the Parcel Map and also shall be recorded as a separate <br /> instrument: <br /> A. The removal of a Native Oak Tree, Heritage Oak Tree, or Historical Tree shall require an <br /> approved Improvement Plan application. Replacement of any tree removed under <br /> Development Title Section 9-1505.3 shall be as specified in Section 9-1505.4. <br /> e. RIPARIAN HABITAT: Parallel to Beaver Slough and the waterway along the western boundary <br /> of Parcel 1 and the designated remainder, a natural open space area for riparian habitat and <br /> waterway protection shall be maintained to provide nesting and foraging habitat and the <br /> protection of waterway quality. The minimum width of said open space shall be one-hundred <br /> (100) feet, measured from the mean high water level of the natural bank or fifty (50) feet back <br /> from the existing riparian habitat, whichever is greater. Water-dependent uses may be permitted <br /> in this buffer. The mean high water level and the edge of the riparian habitat shall be shown on <br /> Conditions of Approval - 1 - PA-0700593 <br />
