Analysis <br /> Background <br /> On December 9, 1976, the Board of Zoning Adjustment approved Excavation Permit No. EP-76-6 to remove <br /> approximately 1.8 million cubic yards of material over a period of five (5) years. <br /> On August 12, 1982 the Board of Zoning Adjustment approved Excavation Permit No. 82-3, for a period of <br /> five (5) years which replaced Excavation Permit No. 76-6. <br /> On March 11, 1988, fhe Planning Division approved Agricultural Excavation Permit No. GX-88-1which was <br /> valid until April 11, 1998. However, the Department of Conservation advised the Planning Division staff that <br /> the farm exemption previously applied under Public Resources Code Section 2714(d)for farming <br /> excavations, was no'longer applicable because the excavation exceeded 1,000 cubic yards and is for <br /> commercial purposes. This provision became effective on October 18, 1997. The project was converted to a <br /> quarry excavation permit. <br /> On November 5, 1998, the Planning Commission approved Quarry Excavation permit No.QX-98-0001 to <br /> excavate 1,000,000 cubic yards of material in three (3) phases over a period of ten (10) years, with a time <br /> limitation date for the quarry excavation permit not to exceed December 31, 2008. <br /> On April 6, 2009, due to the economic downturn, the applicant submitted a Revisions of Approved Actions <br /> application to amendCommunity Development Department Condition No. 1.n. to extend the quarry <br /> excavation permit an additional fifteen (15) years with a new expiration date of December 31, 2023. <br /> The request for a Revision of Approved Actions will not change any other of the previously approved <br /> conditions of approval or the approved Reclamation Plan. However, should the request for the Revisions of <br /> Approved Actions be denied, the applicant will be required to begin reclamation activities as required by <br /> Development Title Section 9-1415.3(1)(0), which requires reclamation shall be completed within two (2) <br /> years from the commencement of the reclamation process. <br /> San Joaquin County ' QX-98-0001\Moffat/Allen <br /> Community Development Page 3 <br />
