i <br /> PROPERTY OWNERS' DOMESTIC WATER WELL AND <br /> WASTE WATER DISPOSAL LICENSE AGREEMENT <br /> This Agreement is entered into on the date set Forth at the end by and between Theodore Camillo <br /> Leventini Jr. and Nanc Jean Leventini Trustees of the Theodore & Nancy Leventini Revocable Trust <br /> Dated October 19, 1999 (collectively referred to as the `Owners") and relates to the real property <br /> identified as APN parcel # 005-180-59 and APN parcel # 005-180-35 are located at 5375 E. Peltier <br /> Road 5199 E. Peltier Road,.and 5301 E. Peltier Road, (collectively referred to as the "Property"). This <br /> agreement is also relevant to Lot Line Adjustment PA-1000108. <br /> 1. Recitals: <br /> a. The two parcels related to the Property abut each other; <br /> I <br /> b. The common domestic water system for the Property relates to a water well located on APN <br /> parcel # 005-180-59 located at 5375 E. Peltier Road. <br /> I c. The domestic water system for APN 005-180-35 located at 5199 E. Peltier Road is provided via a <br /> l pipeline constructed to the well. <br /> d. The waste water disposal system for the Property relates to a septic tank located on APN parcel # <br /> 005-180-35 located at 5199 E. Peltier Road and a leach field located on APN parcel # 005-180-59 <br /> located at 5375 E. Peltier Road. <br /> 2. Grant and Confirmation of License Rights <br /> a. License. The Owners agree and grant to each other an appurtenant to and for the Benefit of the <br /> two abutting parcels, related to the Property, license rights in the water well and the related <br /> water pipeline and related leach field for ingress and egress rights over the Property for the sole <br /> Purpose of providing, maintaining and improving the well, water pipeline and leach field for each <br /> of the parcels related to the Property. <br /> F b. Nonexclusive License. The license granted to each of the Owners is nonexclusive. The Owners <br /> retain the right to make any use of their property that does not interfere unreasonably with the <br /> other Owner's use and enjoyment of the license. <br /> I <br />
