Analysis <br /> Demolition of Existing Church <br /> There is an existing church with two (2) buildings on APN: 111-020-04 and one (1) building on APN: 111- <br /> 020-03. These church buildings cross over the proposed new lot lines. The applicant has stated that <br /> these buildings will be demolished prior to recordation of the Final Map. The demolition of the church <br /> buildings will be a Condition of Approval of this project. <br /> Oak Trees <br /> Development Title Section 9-110.4 defines a Heritage Oak as a native oak tree that has a single-trunk <br /> diameter of 32 inches or greater measured at 4 'h feet above the average ground elevation of the tree. <br /> There are three (3) Heritage Oak trees on the property with diameters of 36 inches each. The applicant <br /> has stated that these Heritage Oak Trees will remain, and an arborist will be hired to trim them to allow <br /> room for the construction of driveways and houses, in compliance with Development Title Section 9- <br /> 1505.5. If the driveway falls within the dripline of the tree, the applicant has stated that they will use <br /> porous surfacing materials in that area pursuant to Development Title Section 9-1505.5(e) (see Site Plan <br /> dated June 27, 2005). The remaining trees on the property are fruit trees and cypress trees and will be <br /> removed as part of the project. <br /> City of Stockton <br /> The City of Stockton states that if the project requires City services, then the applicant will be required to <br /> annex to the City if contiguous to the City or sign a deferred annexation agreement if not contiguous to <br /> the City. The applicant is obtaining public sewer services from the City of Stockton but is not contiguous <br /> to the City. As a result, the applicant will be required to sign a deferred annexation agreement. <br /> Improvements will be made to San Joaquin County standards. <br /> Noise <br /> Caltrans submitted comments requesting "Fair Share" contributions and a noise study for this project. <br /> The County Public Works Department collects traffic mitigation fees that include "Fair Share" fees for <br /> Caltrans. This project is considered to be infill, which exempts it from the provisions of the County Noise <br /> Ordinance, pursuant to Development Title Sections 9-1025.9(a) and (b). In addition, 1-5 has an existing <br /> masonry wall constructed between 1-5 and the project site to provide mitigation from existing <br /> transportation noises. As a result, a separate noise study was not required. <br /> Neighborhood Opposition <br /> The Community Development Department has received two letters opposing this project. The letters include <br /> the following issues: <br /> • Increase in traffic: The County Public Works Department has determined that the amount of traffic <br /> generated by the proposed project is less than significant. <br /> • Density: The General Plan density in the R/M designation allows for 6 to 10 dwelling units per gross <br /> acre, which would permit up to 29 units for this project (2.91 gross acres x 10 dwelling units = 29 units). <br /> The applicant is proposing 23 dwelling units, which does not exceed the General Plan density. <br /> San Joaquin County PA-0500055\Protestant Episcopal Bishop <br /> Community Development Page 3 <br />
