Recommendations
Action
It is recommended that the Planning Commission:
1. Approve the Negative Declaration; and
2. Approve Use Permit Application No. UP-01-5 with the Findings and Conditions of Approval
contained in the staff report.
Findings
1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan,
any applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan
adopted by the County.
• This finding can be made because community churches (Use Type: Religious Assembly—
Community) may be conditionally permitted in the AU-20 zone with an approved Use
Permit application. In addition, the proposed use conforms to the City of Stockton's
General Plan.
2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary
facilities have been provided, and the proposed improvements are properly related to existing and
proposed roadways.
• This finding can be made because adequate utilities, roadway improvements, and
infrastructure facilities have been properly reviewed and mitigated. The City of Stockton
has provided a "will-serve" letter indicating that the project parcel is located within the
City of Stockton South Water System service area and that water services are available.
The Department of Environmental Health is requiring that sewage disposal be served by a
package treatment system. The Department of Public Works is requiring that a detention
pond be constructed to provide adequate storm drainage for the development. In addition,
the Department of Public Works is requiring that driveway approaches be improved in
accordance with requirements of San Joaquin County Standards R-17, Traffic Impact
Mitigation Fees be collected, and the applicants pay fair share of the improvement costs
for installation of a traffic signal at the intersection of French Camp Road and Ponderosa
Street.
3 The site is physically suitable for the type of development and for the intensity of development.
• This finding can be made because the 3.5-acre parcel is of adequate size to accommodate
the number of required parking spaces, building setbacks, and septic and storm drainage
improvements.
San Joaquin County UP-01-51Jehovah's Witnesses
Community Development Pane 5
