Analysis <br /> Background <br /> On October 1, 1992, the Planning Commission approved the 24-lot Major Subdivision (vesting tentative <br /> map). While the tentative map would have typically been valid for three years, or until October 11, 1995, <br /> the State Legislature, due to the slow economy, passed SB 428, which granted an automatic two-year <br /> extension for all valid tentative maps and which extended the life of this tentative map until October 12, <br /> 1997. The State Legislature then passed AB 771, which granted an automatic one-year extension for all <br /> valid tentative maps and which extended the life of this tentative map until October 12, 1998. <br /> During the ensuing years, the economy has remained slow, and while the applicant has been working <br /> toward completion of Phase I, additional time is needed in which to complete Phase I and develop Phase <br /> ll. The requested Time Extension does not alter any of the adopted Conditions of Approval, and <br /> approval of the Time Extension is consistent with the requirements of the Development Title. <br /> Lodi Unified School District <br /> In response to the application referral, the Lodi Unified School District responded that the project will <br /> cumulatively have an adverse impact on the District's ability to provide classroom space to students. <br /> Based upon this, the District stated that approval of the Time Extension is inconsistent with the San <br /> Joaquin County General Plan. <br /> In order to provide mitigation for this cumulative impact on schools, the District has asked the developer <br /> to agree to pay a supplemental school fee of $1.34 per square foot for residential units, in addition to the <br /> required State authorized fee of$1.93 per square foot. In the event the developer does not agree to pay <br /> the additional $1.34 per square foot fee, the District has requested that the Time Extension be denied. <br /> As of the preparation of this staff report, the developer had not agreed to pay the additional fee. <br /> San Joaquin County SU-91-12\Atwood <br /> Community Development Page 5 <br />
