(3) The noise wall shall be included in the Subdivision Improvement Plans. (Development Title Section 9-1150.10) (4) The following note shall be placed on the Final Map: A. At the time of development of Lots1, 2, 7, and 8, if multi-story houses are proposed, the applicant shall provide proof that the second-story will meet the interior sound level requirement of 45 dB prior to submittal of any building permit application. 2. DEPARTMENT OF PARKS AND RECREATION (Staff Contact: Jeff Smith, 953-8800) a. PARK FEES: Due to the relative small size of the subdivision, less than fifty(50) parcels, the San Joaquin County Department of Parks and Recreation will require the collection of in-lieu fees for park development as a requirement for approval of the Map. (Development Title Section 9-1230.8) 3. COUNTY COUNSEL a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, and employees from any claim, action, or proceeding against the local agency or its agents, officers, or employees to attack, set aside, void, or annul an approval of the local agency, advisory agency, appeal board, or legislative body concerning a subdivision, which action is brought within the time provided for in Section 66499.37 of the Government Code. 4. ENVIRONMENTAL HEALTH DEPARTMENT(Staff Contact: Mike Escotto, 468-3443) a. The Environmental Health Department requires a Soil Suitability/Nitrate Loading Study which indicates that the area is suitable for septic tank usage. This must be performed prior to recordation of the Parcel/Final Map(Development Title Section 9-1105.2[d]). A nitrate loading study is required, and a review fee of$465.00 must be paid at the time of submittal to Environmental Health. The sewage disposal system shall comply with the on-site sewage standards of San Joaquin County prior to approval. A percolation test that meets absorption rates of the manual of septic tank practive or the EPA Design Manual for on-site waste water treatment and disposal systems is required for each parcel. A permit fee of$93.00 per percolation hole is required. b. The existing private water wells shall be tested for the chemical Dibromochloropropane(DBCP)and nitrates prior to recordation of the Parcel/Final Map. Samples are to be taken and analyzed by a State approved laboratory (Development Title Section 9-1115.7). c. Connection to an approved public water supply system is required. (Development Title Section 9- 1120.2) A letter from the water supplier will be required which states that they have the capacity to serve the development and that the system meets State standards prior to recording the Final Map. (Development Title Section 9-1100.3) d. Construction of individual sewage disposal systems under permit and inspection by Environmental Health is required at the time of development based on the Soil Suitability/Nitrate Loading Study findings(Development Title Section 9-1110.4). Estate type zoning (R-R1)shall require a double leach field system with an alternating distribution box to be installed at the time of construction.
