Analysis <br /> Background <br /> A Site Approval application for a 360-foot tall radio transmission tower would normally be processed at the <br /> staff level with notification to surrounding property owners. However, this project is being referred to the <br /> Planning Commission due to neighborhood opposition. <br /> A radio tower may be conditionally permitted in the AG-40 zone with an approved Site Approval application. <br /> Neighborhood Opposition <br /> Two letters and a petition with forty-seven signatures were received by the Community Development <br /> Department in opposition to the radio tower. The attorney for the two adjacent land owners to the subject <br /> property listed concerns regarding visual impacts, health issues, and habitat. <br /> Visual Irnpact <br /> The proposed height of the radio tower is 360 feet. It will be located adjacent to State Route 99 on the north <br /> side of Cora Post Road. Cora Post Road must be accessed from the frontage road, so that the residents of <br /> Cora Post must drive by this site to get to their homes. One letter of opposition states that there are 20 to 30 <br /> single family residences in close proximity to the site. <br /> The Development Title does not list a height maximum for a radio tower. The tower must be built so that the <br /> distance to the nearest residence is greater than the height of the tower This tower would not block any <br /> scenic vista or view. There is a wireless telecommunications tower 1000 feet to the north. The Development <br /> Title does not contain a required minimum distance between towers. The tower will be more than 360 feet <br /> from the nearest residence. <br /> Health Concerns <br /> Radio towers are regulated by the Federal Communications Commission (FCC). Data are collected by the <br /> FCC to assess the health and safety risks of their regulations and to minimize interference with electronic <br /> devices. This project will meet all FCC requirements for a radio tower. <br /> Plant/Aninnal Life <br /> The subject parcel is a vacant lot that contains several oak trees. These oak trees will not be removed as <br /> part of this project. The Council of Governments was sent a referral on January 12, 2007. They responded <br /> in a memo dated January 17, 2007 that states that this project is subject to the San Joaquin County Multi- <br /> Species Habitat Conservation and Open Space Plan (SJMSCP) and that this project is located within the <br /> unmapped area. The applicant may participate in the SJMSCP or provide alternative mitigation in an amount <br /> and kind equal to that provided in the SJMSCP <br /> San Joaquin County PA-0600678\Lowry <br /> Community Development Page 3 <br />
