San .Joaquin Vallee
Air Pollution Control District
January 27, 2003
JAN 2 9 2003
Leanne Mueller
San Joaquin County OfI1frlUfl)iY ou`✓Gotirlcur te
Community Development Department
Development Services Division
1810 East Hazelton Avenue
Stockton, CA 95205
SUBJECT: PA-02-00632 (UP) CALIFORNIA CONCENTRATE CO.
Dear Ms Mueller:
The San Joaquin Valley Air Pollution Control District (District) has reviewed the proposed
project and offers the following comments:
The San Joaquin Valley's air quality has been designated nonattainment by the EPA and by the
Air Resources Board (ARB) for 03 (ozone) and PM-10(fine particulate matter, dust). The
Federal Clean Air Act (CAA) and the California Clean Air Act require areas that are designated
nonattainment to reduce emissions until standards are met.
The construction phase of this project can generate emissions from the movement of soil, use of
heavy equipment, bulk materials handling, asphalt paving and other related activities. As a
result, this project is subject to District Regulation VIII (Fugitive Dust Prohibitions). The purpose
of Regulation VIII is to reduce the amount of fine particulate matter (PM-10) entrained into the
ambient air from man-made sources. Regulation VIII has recently been revised, with the
revisions becoming effective May 15, 2002. The applicant may review these changes
on the District web site www.valleyair.org.
In addition, this project may contain operations which are subject to the permitting requirement
of the District. Any equipment subject to the District's Permit to Operate requirements must
obtain an Authority to Construct (ATC) from the District. Construction of equipment that
requires an ATC or construction of any intimateiy related appurtenance, such as foundations
and utility hookups for equipment, cannot begin until an ATC is obtained. This process can take
up to 180 days. Construction of equipment not requiring a District permit is not subject to this
ATC requirement.
To determine specific permit requirements, the applicant should contact the District's Small
Business Assistance Office at (209) 557-6446, or our Permit Services Section at (209) 557-
6400. To avoid unnecessary delays in the project, this should be done as soon as the applicant
has determined the scope of the project.
Da%id L.
