Recommendations Action It is recommended that the Planning Commission: 1. Deny Zone Reclassification No. PA-02-442 based on the inability to make the required "Bases for Zone Reclassification." The proposed zone districts are consistent with the General Plan. • This determination cannot be made because the proposal to remove Condition 1 is inconsistent with General Plan Growth Accommodation Implementation Policy 14.(a)(2), which states that when considering Zone Reclassifications, the fact that adequate services can be made available for the development permitted in the zone shall be considered. In this case, the applicant is requesting that the condition be removed which requires that new development be provided with public services. This request is inconsistent with General Plan policy because it will result in new development with on-site services that, according to the Environmental Health Department, will be inadequate. 2. The proposed zone district is reasonable and beneficial at this time. • This determination cannot be made because creating public health and future environmental problems due to the lack of public services is not considered reasonable or beneficial to the area. Recently, the Central Valley Regional Water Quality Control Board issued a violation of wastewater discharge to the Arbor Mobile Home Park located on the east side of State Route 99. The mobile home park has endured severe flooding and drainage problems in the past 25 years, which has resulted in the evacuation of people by boat and 4-wheel-drive vehicles. The Environmental Health Department has indicated that similar public health and environmental problems could occur on the proposed project site if zoning Condition 1. is eliminated.
