Analysis <br /> Oak Trees <br /> Along the western boundary of the site are twelve Heritage Oak Trees and four Native Oak Trees. <br /> Development Title Section 9-110.4 defines a Heritage oak tree as a native oak tree that has a single trunk <br /> diameter of thirty-two (32) inches or greater measured at four and one-half (4'/z) feet above the average <br /> ground elevation of the tree. A native oak tree is defined as a valley oak (Quercus lobata) with a trunk <br /> diameter of six (6) inches to less than thirty-two (32) inches for a single trunk tree, or a combined trunk <br /> diameter of eight (8) inches or greater for a multi-trunk tree, measured four and one-half(4'/) feet above the <br /> average ground elevation of the tree, or an interior live oak (Quercus wislizenii), California live oak (Quercus <br /> agrifolia), or blue oak (Quercus douglasii) with a trunk diameter of four (4) inches to less than thirty-two (32) <br /> inches for a single trunk tree, or a combined trunk diameter of six (6) inches or greater for a multi-trunk tree, <br /> measured four and one-half(4%) feet above the average ground elevation of the tree. <br /> To protect and preserve heritage oak trees and native oak trees from development and construction activity, <br /> certain standards contained in Development Title Section 9-1505 shall be applicable to grade changes near <br /> or within the drip line of said oak trees. No grade changes shall occur within six (6) feet of the trunk of the <br /> tree. No grade changes shall occur that entail removing or adding more than six (6) inches of soil in the <br /> protected zone of the tree. Any grade changes within the protected zone of tree shall be accomplished so <br /> as to prevent soil compaction and injury to or removal of the tree's roots. Before grading operations may <br /> commence, a minimum five (5) foot high chain link fence or other comparable protective fencing shall be <br /> installed at the outermost edge of the protected zone of each tree or group of trees. No trenching <br /> whatsoever shall be.allowed within the protected zone of subject trees and paving within the drip line of <br /> affected trees shall be minimized. If paving is necessary, porous materials shall be used. (Development <br /> Title Section 9-1505.5). <br /> Furthermore, the applicant will be required to comply with the Trees Chapter of the.Development Title <br /> Section 9-1505. If the applicant chooses to remove any oak tree, he must apply for an improvement plan <br /> and meet the tree removal requirements of the Development Title. <br /> Noise <br /> Development Title Section 9-1025.9 lists the Residential use type as a noise sensitive land use. Moreover, <br /> Development Title Section 9-1025.9(d) states that the Review Authority shall require the.preparation of an <br /> acoustical study in instances where it has determined that a project may expose existing or proposed noise <br /> sensitive land uses to,noise levels exceeding the noise standards specified in Table 9-1025.9. Due to the <br /> proximity of the project to State Route 99 W. Frontage Road, an acoustical study was required. In January <br /> 2006, the applicant submitted a Noise Study prepared by The Acoustics & Vibration Group. The study <br /> identified potentially significant noise impacts from State Route 99 W. Frontage Road and provided <br /> mitigation measures to reduce these impacts to a less than significant level. The mitigation measures <br /> include the following and will be added as a condition of approval to the project: <br /> • A sound wall made of the combination of earth berm and solid structure shall be built along the <br /> eastern property lines of Parcels 1, 2, and 8. A minimum wall height of 12 feet shall be used <br /> starting at the north end of Parcel 1. The wall height shall increase to a minimum of 13 5 feet at a <br /> point across from the on-ramp to southbound SR 99. The wall shall wrap around the entrance to <br /> the project approximately 30 feet. A minimum wall height of 15 feet shall be used starting at the <br /> north end of ,Parcel 8 and continue along the eastern property line to the south end (see the <br /> January 2006 Acoustical Study prepared by The Acoustics &Vibration Group). <br /> San Joaquin County' PA-0500329/Champion <br /> Community Development Page 3 <br />
