REASON FOR RECOMMENDATION: On July 28th, Dewey George filed a Agricultural Grading Excavation Permit (GX-95-1) for the stated purpose of stabilizing the Calaveras River bank along his orchard. Mr. George's application was not in compliance with the Development Title provisions for Agricultural Excavation Permits. However, staff took the position that if Mr. George's project would stabilize the riverbank along his orchard and prevent erosion and future losses of orchard land from flooding that it would meet the spirit of the ordinance. Since the time Mr. George filed the application, we have had numerous meetings and requests for information to support the project. The chronology is as follows: 7-28-95 Full application submitted. 8-2-95 Project deemed complete for processing. 8-9-95 Tom Gau, Tom Walker, Kerry Sullivan and Chandler Martin met to discuss application and determine course of action. Project will be divided into two projects and Chandler will assemble technical advisory committee. 8-23-95 Letter to Dewey George. Noted that the first step in CEOA review is to prepare an Initial Study. Noted that the Initial Study cannot be prepared until several issues are resolved. This followed a phone call of 8-18-95 from Chandler Martin to Dewey George. 3-24-95 DC memo states that Initial Study cannot be prepared until issues are resolved. The Community Development Department cannot support the project as submitted. 8-30-95 DC meeting. The applicant did not attend. 9-5-95 Meeting at project site with Dewey George, Mr. George's grading contractor, a neighbor, Dave Swarbrick, Dewey George's engineer and Dave Swarbrick's wife. 9-12-95 Tom Gau met with Dewey George.
