This waiver would allow <br /> light irrigation of three hundred trees and plants located on our property. We are dealing <br /> with what we believe is a relatively insignificant volume of water and would pose an <br /> extremely low threat to the environment and the water quality. In a phone interview with <br /> Ms. Kim Williams prior to your reorganization, it was suggested to us that such an <br /> application would be appropriate. <br /> By way of historical review: we began operations as Central Valley Steam Cleaning in <br /> 1984. We subsequently closed our operation when it was deemed to be environmentally <br /> unsound. In an effort to remain in the truck wash industry, and to do so within the <br /> appropriate regulations, we embarked on a study of available water reclamation systems. <br /> This effort included countrywide facility inspections to examine systems currently in use. <br /> After many months we entered into contractual agreements with WaterCycle, <br /> Incorporated and their distributor Blue Shores, Incorporated. Upon successfully obtaining <br /> a seven-digit loan, property was purchased the construction and equipment installation <br /> commenced. <br /> Early in the start up phase it became evident that the reclamation system would not <br /> perform as warranted. This failure required our company to truck off recycled rinse <br /> water, at great expense, to a city operated disposal site. <br /> The investment of three years, together with large debt service, forced us to turn to the <br /> court for redress. In a long five week trial the court awarded judgment in our favor and <br /> set the funds required to build a thirty five hundred foot sewer connection. The defendant <br /> has delayed the judgment by filing an appeal. Our legal counsel has indicated that this <br /> appeal is little more then a delaying tactic. The defendant purchased a bond for the <br /> amount of the judgment as per a court order. A ruling on the appeal is due within the next <br /> twelve to fourteen months. The city of Stockton was represented in the trial; they testified <br /> that they would allow us to construct a sewer if we paid for the construction. <br /> Clearly, our company has shown extreme sensitivity to regulatory agencies, in total <br /> support of insuring safe and sound water treatment policies. It is our feeling that this <br /> request for temporary relief will not endanger or encroach upon sound environmental <br /> guidelines. <br /> "Located at Mariposa Rd. and Hwy 99 in Stockton, California." <br />
