Item No . 2 <br /> PC : 1-7-88 <br /> UP-88-15 <br /> Page 1 <br /> RECOMMENDATION <br /> It is recommended that the Planning Commission: <br /> 1 . Approve a Negative Declaration and instruct the Clerk to file <br /> a Notice of Determination; and <br /> 2 . Approve Use Permit Application No. UP-88-15 based on the fin- <br /> dings in the staff report and subject to the conditions of <br /> approval in the staff report . <br /> FINDINGS <br /> 1 . "The establishment , maintenance, and operation of the use <br /> does not conflict with the General Plan. " <br /> ° Staff can make this finding because the project is con- <br /> sistent with the General Plan Industrial policies . <br /> 2 . "Adequate utilities, access roads, sanitation, drainage, and <br /> other necessary facilities have been provided, and the pro- <br /> posed improvements are properly related to existing and pro- <br /> posed streets and highways . " <br /> ° Staff can make this finding because facilities are already <br /> in place, or their provision will be required as conditions <br /> of approval for this Use Permit . <br /> 3 . "The property involved is of adequate size and shape to <br /> accommodate the proposed use and all yards, building <br /> coverage , setbacks, parking areas, and other requirements of <br /> this Title. " <br /> Staff can make this finding because the use currently meets <br /> code requirements as demonstrated by the site plan sub- <br /> mitted with the Use Permit application. <br /> 4 . "Issuance of the permit will not be significantly detrimental <br /> to the public health, safety, or welfare or be injurious to <br /> the property or improvements of adjacent properties . " <br /> ° Staff can make this finding because the truck terminal use <br /> already exists, and this expansion can be added without <br /> being detrimental to the area. <br /> PROJECT DESCRIPTION <br /> The proposed project is to add 49 loading docks to the 28 <br /> existing docks at the Yellow Freight truck terminal .
