Analysis <br /> Background <br /> On November 25, 1998, the Community Development Department denied Site Approval Application No. SA- <br /> 98-68 for a 672-square-foot, 45-foot-high, single-faced, illuminated billboard. The project was denied <br /> because the proposed site is located within 1,000 feet of a billboard approved on November 18, 1998,as Site <br /> Approval No. SA 98-65, <br /> On November 30, 1998, Mike Hakeem, representing Obie Media, appealed the Community Development <br /> Department's denial of the project. <br /> Applicant's Appeal <br /> Appeal Statement No. 1 <br /> In the appeal, Mr. Hakeem made the following statement: <br /> "Spacing requirements between SA-98-65 and SA-98-68 are not applicable given SA-9M5 application <br /> invalidity due to failure to consider CAL TRANS right-of-way requirements." <br /> Response to Appeal Statement No. 1 <br /> Spacing requirements are applicable. Development Title Section 9-1710.6 requires a minimum 1,000 feet <br /> between off-premises signs. The proposed sign is approximately 850 feet from a billboard approved as SA- <br /> 98-65. <br /> Site Approval No. SA-98-65 for a 672-square-foot,45-foot-high,double-sided billboard sign at the northwest <br /> corner of Hammer Lane and State Route 99 was approved by the Community Development Department on <br /> November 18, 1998. The Department of Public Works and Cal-Trans reviewed and approved the <br /> application. <br /> Appeal Statement No. 2 <br /> In the appeal, Mr. Hakeem made he following statement: <br /> "Failure of SA-98-65 to obtain State permit approval prior to applying with the County of San Joaquin! <br /> Response to Appeal Statement No. 2 <br /> It is not a requirement to obtain Cal-Trans or State permit approval prior to applying for a Site Approval <br /> application or prior to the project's approval by the Community Development Department. <br /> San Joaquin County SA-98-68\Mar <br /> Community Development Page 3 <br />
