CONDITIONS OF APPROVAL SA-98-65 Suthar Site Approval Application No. SA-98-65 was approved by the San Joaquin County Planning Commission on February 18, 1999. The effective date of approval is February 28, 1999. This approval will expire on August 28, 2000, which is 18 months from the effective date of approval, unless (1) all Conditions of Approval have been complied with, (2) all necessary building permits have been secured and remain in force,and (3) all necessary permits from other agencies have been secured and remain in force. Unless otherwise specified,all Conditions of Approval and Ordinance requirements shall be fulfilled prior to the establishment of the use and the issuance of any building permits. Those Conditions followed by a Section Number have been identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot be modified, and other Ordinance requirements may apply- 1. pply.1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Jeff Fisher,468-9653) a. BUILDING PERMIT: Submit a Commercial Building Permit application. The Site Plan required as part of the building permit must be prepared by a registered civil engineer or licensed architect This Plan must show drainage,driveway access details(including gates), on-site parking,landscaping,signs, existing and proposed utility services,and grading(refer to the "Site Plan Check List" for details). A fee is required for the Site Plan review. (Development Title Section 9-884) b. APPROVED USE: This approval is for one off-premises outdoor advertising sign as shown on the Plan submitted September 25, 1998. The sign will be a single pole and double sided. It will have a 14-foot by 48-foot sign face and be 45 feet high. C. SIGNS: All portions of any sign shall be set back a minimum of five(5)feet from any future right-of-way line, including any corner cut-off (snipe). (Development Title Section 9- 1710.2Ig1). d. CALTRANS APPROVAL: Building plans shall be approved by Caltrans, Outdoor Advertising. 2 DEPARTMENTOF PUBLIC WORKS (Staff Contact: Gabe Karam,468-3000) a. This Site Approval shall expire if and when it is necessary to remove the sign due to improvementsto the State Route 99 and Hammer Lane interchange,provided the applicant is unable to relocate the sign pursuant to Condition No. 2.c., supra. Upon expiration of this Site Approval,the applicant,upon 90 days written notice,shall remove the sign structure at the applicant's sole cost and expense. In the event the applicant fails to remove the sign structure,the applicant shall provide access to allow removal of the sign structure and shall reimburse the County,in full,for the costs and expenses of such removal. b. A bond in the amount of$5,000 shall be posted and maintained with the San Joaquin County Departmentof Public Works. Conditions of Approval - 1 - SA-98-65
