i <br /> The Department of Public Works did not require the raised median as the applicant redesigned the <br /> driveway to one-way.ingress and one-way egress. The Department of Public Works has included the <br /> No-Parking'zone as,a recommended Condition of Approval. Roadside vegetation was not included <br /> because Developme�t Title Section 1020.7 requires a ten foot wide landscaped strip along adjacent <br /> streets. The Conditions of Approval will ensure the potentially significant traffic related impacts will be <br /> reduced to a less-than-significant level. <br /> Services: The project site is not required to be served by public services: The septic system and water <br /> well will be constructed under permit and inspection of the Environmental Health Department. The on- <br /> site retention basin will be reviewed and approved by the Community Development Department Building <br /> Division. <br /> Land Use: This project conforms with the current zoning of C-G (General Commercial) and the General <br /> Plan designation of CIG (General Commercial). The surrounding uses are commercial to the north, <br /> residential to the east and south, and the frontage road abuts the property to the west. The proposed use <br /> may be conditionally permitted in the C-G zone with an approved Use Permit application. <br /> Trees: The neighbors to the east submitted a letter of support but mentioned concern about preservation <br /> of the trees adjacent to their property. The applicant is subject to the Development Title's provisions to <br /> protect and preserve oak trees from development and construction activity. There are three oak trees on <br /> the property. One heritage oak tree is located near the eastern property line. There are two native oak <br /> trees; one located in the center of the parcel and one near the southern property line. The applicant has <br /> stated he will be preserving the heritage oak tree but removing the two native oak trees. A native oak <br /> tree may be removed,subject to an approved Improvement Plan. Development Title Section 9-1505 <br /> requires each native oak tree removed to be replaced with three (3)trees or acorns, or combination <br /> thereof. <br /> East Bay Municipal Utility District <br /> The East Bay Municipal Utility District(EBMUD) owns the parcel to the north of the subject parcel and has <br /> three underground aqueduct pipelines located on the EBMUD parcel. EBMUD sent a response letter <br /> dated November 19, 2008 requesting the following: <br /> Rig ht-of-way.surface drainage will need to be maintained and no drainage will be allowed from <br /> adjacent property. <br /> An 8-foot tall concrete block wall will need to extend the full distance of the right-of-way on the <br /> applicant's side of the property line. <br /> • Septic tank and leach field will need to be designed to assure there is no contamination of <br /> EBMUD property. <br /> • Design drawings for any project encroachment (roadway, utility, facility, etc) crossing the right-of- <br /> way will need to be submitted for proper review, approval and permitting. Design drawings for <br /> any projects.planned adjacent to the Aqueduct right-of-way should also be submitted to EBMUD <br /> for review of,possible drainage, site grading, fencing, construction access, and other conditions <br /> that affect the property. <br /> Contractor will have to apply through the EBMUD office in Stockton for a permit to enter or use <br /> EBMUD right=of-way for any construction purpose. <br /> Parking spaces for the project seem inadequate.
