Consent of Other Parties. DEVELOPER may, at <br /> its discretion, elect to have other holders of legal, equitable <br /> or beneficial interests in the Project Site, or portions thereof, <br /> acknowledge and consent to the execution and recordation of this <br /> Agreement by executing a document substantially in the form of <br /> the Acknowledgment and Consent to Development Agreement, attached <br /> hereto as Exhibit E. It is understood that the execution of such <br /> document by other holders of legal, equitable, or beneficial <br /> interest in the Project Site is not a condition precedent to this <br /> Agreement. <br /> Section 11 . Assignment and Notice.
