CONDITIONS OF APPROVAL <br /> PA-1300141 <br /> TAVARES/ASPEN SURVEY <br /> Minor Subdivision Application No. PA-1300141 was approved by the Community Development <br /> Department on December 4, 2013. The effective date of approval is December 14, 2013. This <br /> tentative map approval will expire on December 13, 2016, which is three (3) years from the effective <br /> date of approval, unless (1) all Conditions of Approval have been complied with and (2) a Parcel Map <br /> has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as ordinance requirements pertinent to this application. Ordinance requirements cannot be <br /> modified and other ordinance requirements may apply. <br /> 1 COMMUNITY DEVELOPMENT DEPARTMENT: (Staff Contact. Rick Griffin, [209]468-3154) <br /> a. TENTATIVE MAP: The Parcel Map shall substantially conform with the approved tentative map <br /> dated August 14, 2013. <br /> b RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note <br /> shall be placed on the Parcel Map and recorded as a separate instrument: <br /> All persons purchasing parcels within the boundaries of this approved map should be prepared to <br /> accept the inconveniences or discomforts associated with agricultural operations or activities, such <br /> as noise, odors, insects, dust or fumes. San Joaquin County has determined that such <br /> inconveniencies or discomforts shall not be considered to be a nuisance. <br /> c LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) Parcel 1 shall have a minimum lot width of 150 feet. (Development Title Section 9-610.4) <br /> (2) Parcel 1 shall be between two (2) gross acres and five (5) gross acres in size. (Development <br /> Title Section 9-610.3[a]) <br /> d. TRANSFER RESTRICTION: A Note shall be placed on the Parcel Map and a Notice of Minor <br /> Subdivision Restriction shall be recorded concurrently with the Parcel Map, with a reference to the <br /> instrument number of said recorded notice, stating that: <br /> (a) The homesite shall not be transferred until December 4, 2023, or upon the <br /> death of an owner owning at least fifty (50) percent interest in the homesite <br /> parcel, unless the homesite parcel and the remainder parcel are merged <br /> pursuant to the provisions of the Development Title. <br /> (b) The property shown on the Parcel Map is restricted from further subdivisions for <br /> homesite purposes, except for financing only, by Section 9-610.3 of the San <br /> Joaquin County Development Title. <br /> e PROPERTY LINE SETBACK: The following requirements shall apply: <br /> (1) The structures located on Parcel 1 shall meet the setback requirements for the AG-40 zoning <br /> designation (General Agriculture, 40-acre minimum) for non-agricultural and agricultural <br /> structures. (Development Title Section 9-610.2) <br />
