R5-2009-0097), LUCCA WINERY, SAN JOAQUIN <br /> COUNTY <br /> On 22 November 2011, Central Valley Water Board staff received an Application Referral <br /> Notice for the San Joaquin County Community Development Department. Based on that <br /> notice, we understand that you plan to construct a small winery in Ripon. <br /> If your winery will generate rinse water or process wastewater to anywhere other than a <br /> community sewer system, you are required to submit a Report of Waste Discharge to apply for <br /> either Waste Discharge Requirements (WDRs) or a waiver of WDRs. This requirement is set <br /> forth in Section 13260 of the California Water Code, which states, in part: <br /> 13260. (a) Each of the following persons shall file with the appropriate regional <br /> board a report of the discharge, containing the information that may be required <br /> by the regional board: <br /> (1) A person discharging waste, or proposing to discharge waste, within any <br /> region that could affect the quality of the waters of the state, other than into a <br /> community sewer system. <br /> Many small wineries that either land apply process wastewater and residual solids to land or <br /> transport such waste offsite for disposal at a permitted facility can qualify for coverage under a <br /> conditional general waiver of WDRs that was adopted by the Central Valley Water Board in <br /> 2009. The waiver, monitoring and reporting program, annual monitoring report form, and the <br /> application forms can be downloaded from our website at <br /> http://www.waterboards.ca.gov/centraIvaIley-/­`board decisions/adopted orders/#Waivers <br /> under the heading "Small Food Processors and Small Wineries — Order No. R5-2009-0097'. <br /> If you believe that your facility will qualify for coverage under the waiver, you must submit a <br /> Report of Waste Discharge that consists of the following: <br /> 1. A completed and signed Form 200; <br /> California Environmental Protection Agency <br /> tro Recycled Paper <br />
