CONDITIONS OF APPROVAL <br /> PA-1100040 <br /> ZOlezzi <br /> Minor Subdivision Application No. PA-1100040 was approved by the San Joaquin County <br /> Community Development Department on April 19, 2011. The effective date of approval is April 29, <br /> 2011. This tentative map approval will expire on April 28, 2014, which is three years from the <br /> effective date of approval, unless (1) all Conditions of Approval have been complied with and (2) a <br /> Parcel Map has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> f be modified, and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT.(Staff Contact: Rick Griffin, (209]468-3154) <br />' a. TENTATIVE MAP: The Certificate of Compliance shall substantially conform with the approved <br /> tentative map dated March 4, 2011. <br /> b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note <br /> shall be recorded as a separate instrument with the Certificate of Compliance.- <br /> (1) <br /> ompliance:(1) All persons purchasing parcels within the boundaries of this approved map should be prepared <br /> to accept the inconveniences or discomforts associated with agricultural operations or activities, <br /> such as noise, odors, insects, dust or fumes. San Joaquin County has determined that such <br /> inconveniencies or discomforts shall not be considered to be a nuisance. <br /> c. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) All parcels shall have a minimum lot width of 330 feet, measured at the front yard setback line. <br /> (Development Title Section 9-610.4) <br /> (2) All parcels shall have a minimum lot area of forty(40) acres. (Development Title Section 9-610.2) <br /> d. CERTIFICATE OF COMPLIANCE: A Certificate of Compliance is required for all parcels. The <br /> property descriptions submitted with the Certificate of Compliance application shall substantially <br /> conform with the approved tentative map dated March 4, 2011. A fee is required to process the <br /> Certificate of Compliance application. (Development Title Section 9-890.4) <br /> e. RIPARIAN HABITAT: Parallel to the Stanislaus River, a natural open space area for riparian <br /> habitat and waterway protection shall be maintained to provide nesting and foraging habitat and <br /> the protection of waterway quality. The minimum width of said open space shall be one-hundred <br /> (100) feet, measured from the mean high water level of the natural bank or fifty (50) feet back <br /> from the existing riparian habitat, whichever is greater.
