CONDITIONS OF APPROVAL <br /> PA-1500271 (MS) <br /> G&E TE VELDE ORCHARDS, INC./DILLON & MURPHY <br /> Minor Subdivision application no. PA-1500271 was approved by the San Joaquin County <br /> Community Development Department on March 23, 2016. The effective date of approval is April 2, <br /> 2016. This tentative map approval will expire on April 2, 2019, which is three (3) years from the <br /> date of approval, unless (1) all Conditions of Approval have been complied with and (2) a Parcel <br /> Map has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as ordinance requirements pertinent to this application. Ordinance requirements cannot be <br /> modified and other ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Rick Griffin, [209]468-3154) <br /> a. TENTATIVE MAP: The Parcel Map shall substantially conform with the approved tentative <br /> map dated January 25,2016. <br /> b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following <br /> note shall be placed on the Parcel Map and recorded as a separate instrument: <br /> All persons purchasing parcels within the boundaries of this approved map should be prepared <br /> to accept the inconveniences or discomforts associated with agricultural operations or activities, <br /> such as noise, odors, insects, dust or fumes. San Joaquin County has determined that such <br /> inconveniencies or discomforts shall not be considered a nuisance. <br /> c. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) Parcels 2 and 3 shall have a minimum lot width of 150 feet. (Development Title <br /> Section 9-610.4) <br /> (2) Parcels 2 and 3 sha!! be between two(2) gross acres and five(5) gross acres in size. <br /> (Development Title Section 9-610.3[a] <br /> d. TRANSFER RESTRICTION: A Note shall be placed on the Parcel Map and a Notice of Minor <br /> Subdivision Restriction shall be recorded concurrently with the Parcel Map, with a reference to <br /> the instrument number of said recorded notice, stating that: <br /> The homesites shall not be transferred until March 23, 2026, or upon the death of an <br /> owner owning at least fifty (50) percent interest in the homesite parcel, unless the <br /> homesite parcel and the remainder parcel are merged pursuant to the provisions of the <br /> Development Title. <br /> The property shown on the Parcel Map is restricted from further subdivisions for <br /> homesite purposes, except for financing only, by Section 9-610.3 of the San Joaquin <br /> County Development Title. <br /> e. ACCESS: The following access requirements apply and shall be shown on the Parcel <br /> Map: <br /> (1) A proposed 25-foot wide private easement for access to Parcel 2, along the <br /> Designated Remainder, shall be shown on the Parcel Map.
