I
To: San Joaquin County Development Department
AUG - ` 2008
Re: Munn and Perkins Application: QX-89-0002 Community Development Dept
I am an older man who has lived on River Rd.for over 50 years. I am saddened by how
you have let this plant take over the area without regard to the neighbors and community. i
When Aggregates bought this property in the eighties,it was a very small plant with a
few trucks corning in and out and the only annoyance was their loud beepers I could
occasionally hear. They never worked nights or weekends and started at about 7:30 in
the morning and went until 3:00 p.m.Now,they have a huge three story deafening
processing plant with dust blowing all over, and are working many more hours. This is
not the same plant that is was when it was purchased. How on earth has it come to this
where a company can take over the community?
In the last five years, this plant had grown at least ten fold. I recently counted over 1,000
trucks going in and out of the plant in one day. Most of the time the trucks park on the
sides of River Rd.waiting their turn to enter the plant. This is a traffic hazard. This area
is zoned AG-40 agriculture and OS/O open ground,not commercial,refinery,or a
processing plant which is what this plant has turned into. Most of the trucks entering the s
plant are the plants own trucks delivering material to be processed. This company has
many other plants where this could be done. Even after numerous neighbors complained,
you let them build an underground multi-million dollar conveyer to dig up farmland
which now attracts every off road vehicle in the area. When is enough simply enough? z
I have complained to the plant directly and was referred to Steve Clement. He told me
that the noise was unbearable for the employees as well, and that there was no reason the
plant couldn't control the noise and enclose it. Unfortunately,he no longer works there,
and of course nothing was ever done. I was basically told that there permit is
grandfathered in and they can essentially do whatever they want, as long as they say they
are"trying"to control the noise and dust. This is ridiculous because all businesses I
know have to comply with current regulations.
i
I am amazed that you are even considering letting them work more hours. Sixteen hours
a day 7 days a week is enough. They are already starting earlier than what is allowed in
their permit and in 2005 worked over 100 nights. I wrote them down. The dust, fallen
boulders and trucks driving so slow out of the plant make it a hazard just to drive down z
the road. My windshield has been broken many times by trucks.
I
This plant has a huge history of disobeying any regulations put on them. They first
started working nights without notifying anyone. Then they notified the neighbors but
worked many nights that they did not have permission to. When I called you for help
your planners didn't even know if there was a cap on nights or what there permit actually
said. Finally Kerry Sullivan stepped in and put an end to their working nights. To get
around this, the plant then expanded without any permits and added additional crushers
and sand shakers which are deafening, and you just gave them a slap on the hand.
