Mitigation Measures: Mitigation Measure 3.1.1: All outdoor lighting will be required to be fully shielded and shall adhere to Section 9-1025.6 of the Development Code in order to minimize any impacts resulting from outdoor lighting on adjacent properties (Final EIR, p. 3.1-5). Findings: Based on the whole record, this Commission finds that with implementation of Mitigation Measure 3.1.1, offully shielding and compliance with the County Development Code impacts related to light and glare are reduced to a less than significant level(Final EIR,p. 3.1-5). D.3. FINDINGS REGARDING IMPACTS ANALYZED IN THE EIR AND DETERMINED TO BE SIGNIFICANT AND UNAVOIDABLE This section includes findings for project impacts which are determined to be significant even with the imposition of mitigation measures. These impacts cannot be mitigated to a less than significant level and therefore remain unavoidable. Although this Commission finds that all significant impacts of this project listed below cannot be substantially lessened or avoided by the imposition of mitigation measures or alternatives, the mitigation measures found in the EIR and listed below will be implemented to lessen the project's impact. Specific findings of this Commission for each impact are set forth below in this section. This section, together with Section G of the findings below, addresses the requirements in CEQA Guidelines Section 15093. CEQA requires the lead agency to balance the benefits of a proposed project against its unavoidable significant environmental impacts and to determine whether the impacts are acceptably overridden by the project benefits(outlined in Section F). As described herein,project-level unavoidable significant impacts would occur in the areas of Air Quality/Climate Change and Noise. Air Quality and Climate Change Impact 3.31 The project could create objectionable odors affecting a substantial number of people(Final EIR, p. 3.3-18.) Significance Before Mitigation: Potentially Significant Facts: With regards to odor,the number of complaints(nine unconfirmed within three years)is considered potentially significant. While dispersion modeling does not show a significant impact based on HZS concentration, the record of previous odor complaints and the potential for increased sensitivity at night, would result in a potentially significant impact (Final EIR,p. 3.3- 19).
