Additionally,the CPUC is missing from the Regulatory Setting under the <br /> State Agencies and is considered the expert on rail safety for the purpose of this review. <br /> The above substantial evidence as submitted raises the question; can the Planning Commission <br /> make the best informed decision without all the necessary information before them,as CEQA <br /> requires that a lead Agency neither approve nor carry out a project as proposed if there are feasible <br /> alternatives or mitigation measures that would avoid or substantially lesson the significant <br /> environmental effects of this project(CEQA Guidelines Sections 15021, 15091,and 15092). <br /> Without recirculation of the Transportation Traffic Section of the FEIR,the finding in the staff <br /> report under Transportation and Traffic is without merit, since the traffic analysis failed to include <br /> the at-grade railroad crossings and therefore, a determination for No Mitigation Measures is <br /> without justification and grounds not to certify the Transportation Traffic Section of the FEIR as <br /> presented. <br /> We do however, concur with the staff recommendation as presented in the staff report; Deny the <br /> Revisions of Approved Actions Quarry Excavation." <br /> Please advise us of the Planning Commission decision for the proposed project FEIR. <br /> Thank you for your consideration of these comments.
