Robert Stuart (26002 East River Road, Escalon) The current request by Munn and Perkins is unreasonable <br /> and I live 1 1/miles west of the plant.When trucks operate at night my kids can not sleep, because the <br /> trucks use the Jake brakes and it shakes the windows when they come to a stop. A live monitor will not <br /> have an affect on the drivers once they leave the site.The nighttime operations will drive us from our homes <br /> and my kids should not be subjected to 125 sleepless nights. Property values will be diminished significantly <br /> if Munn and Perkins are permitted to operate at night. I have spent over $20,000.00 on studies to identify <br /> the significant impacts from noise and odor. <br /> Commissioner Johnson, asked, "How many years have you lived at this site?" <br /> Mr. Stuart responded, "15 years." <br /> Jim Mayol (26144 East River Road, Escalon) Lived in the area for about 11 years near Mc Henry and River <br /> Road. The noise will not only affect my home but many homes in the area along the haul routes. The trucks <br /> are in and out constantly because they bring in ripped up asphalt and dump it at the project site. The FEIR is <br /> misleading because we live 980' off of River Road and we still hear the trucks coming from the site even <br /> with double paned windows. He stated, "The majority of these trips will occur during the summer and I would <br /> not be able to enjoy the Delta Breeze if I have to close my windows because of the noise from the trucks." <br /> Also, the odor has been unbearable in the last few years and you can smell it as far as Jacob Meyer Park. <br /> All of the proposed mitigation measures are speculative and Munn and Perkins do not state the true facts of <br /> this project". California Real estate disclosure forms require us to list all known problems and this would hurt <br /> the sale of our properties. Also, house fans do not work in drowning out the truck noise but as a result of <br /> using this method it brings in the smell of the asphalt plant into the house. <br /> Commissioner Hamilton stated, "Living west of the plant, the main problem you have is the trucks operating <br /> at night." <br /> Mr. Mayol, responded, "Yes,the noise and odor, and we do wake up at night despite what the studies <br /> report." <br /> Martin Adrian (22201 Burwood Lane, Escaion)said, "I have lived and worked on River Road for my entire <br /> life. It distresses me to speak against Munn and Perkins as I have supported many of there past projects." <br /> However,the applicants have been misleading in this request and just as recent have co-existed with the <br /> plant. Although the plant has been here since the 1950's the plant has expanded the buffer area. We have <br /> been robbed of the peace and tranquility of our properties.When they built the sand plant and upgraded the <br /> plant the noise increased and sounded like a freight train coming through my home. I have tried to work with <br /> Munn and Perkins over the years and when contacted by me I achieved little success and as recently as <br /> 2010 was told I will have to accept the nighttime operations as it would be only until 2029. The rubberized <br /> asphalt odor permeates the area and the plant wants us to give up our way of life, however, the plant is not <br /> willing to give up anything for the neighbors. Sixteen hours a day is enough, but twenty-four hours is too <br /> much for this location. <br /> Terpstra pointed out the letter from J.C. Brennan to the Commission challenging the conclusions of the <br /> Bollard Noise Study is the reason why the FEIR was prepared because there is a 97% chance of awakening <br /> at night from the noise of the trucks. The background traffic noise in the FEIR reports that only 2-3 auto <br /> trucks pass at night and if the increase in trucks at night is prevalent then lt can be concluded that the <br /> majority of noise at night along River Road will come from the trucks. The City of Riverbank residents along <br /> Santa Fe Road and First Streets have the same issues my clients have and are additionally recommending <br /> further studies.This is why the December Staff Report was conclusive in recommending denial because <br /> Finding No. 3 can not be made in the affirmative because of the significant amount of awakening. <br /> PC MINUTES 5 PC: 2-2-12 <br />
