("APPLICANT'), DRAFT ENVIRONMENTAL IMPACT REPORT <br /> ("dE1R"), SAN JOAQUIN COUNTY("LEAD AGENCY'), STATE CLEARINGHOUSE# <br /> (SCHN 2005082009 <br /> Central Valley Water Board staff (Staff) has completed review of the dE1R for the Project B-1 <br /> received in our office on 11 May 2011. The review focused on the water rights and water <br /> quality aspects of the proposed Project. The Munn & Perkins Quarry ("Site") is currently <br /> permitted under Central Valley Water Board Order# R5-2009-0048 for waste discharges to <br /> land. Furthermore, the Site has submitted a Notice of Non-Applicability for'coverage under <br /> National Pollutant Discharge Elimination System (NPDES) General Permit CAS000001 for <br /> Discharges of Storm Water Associated with Industrial Activities. <br /> Under Section 2.7 of the dEIR the Applicant states that: <br /> "Other than extending the hours of operation, existing quarry operations will not be <br /> expanded or otherwise modiiled. The intention of the project is to provide asphalt <br /> paving materials for projects that contain specific requirements that limit work to <br /> nighttime hours. The project will entail the use of the asphalt batch plant, loaders, <br /> trucks (including a water truck), and a scale house. These uses are currently <br /> permitted during daytime hours as accessory uses to the existing approved quarry <br /> excavation permit. Excavation activities and rock crushing will not be permitted <br /> during the extended nighttime hours. Extending quarry operating hours will not <br /> increase the quarries footprint, depth of excavation, or maximum daily production B-2 <br /> limits. Furthermore, extending the quarries operating hours will not alter or <br /> otherwise change the approved reclamation plan." <br /> Based on the statement above, our office cannot anticipate the proposed Project making an <br /> significant material changes in water rights or water quality. However, per California Water <br /> Code (CWC) § 13264, if in the future, the Project makes any material change in waste <br /> discharge either in type or quantity, the Applicant must file a Report of Waste Discharge <br /> (ROWD) per CWC § 13260. <br /> California Environmental Protection Agency <br /> ��Recycled Paper <br />
