Box 4760 <br /> Modesto, CA 95352— <br /> RE Q UEST <br /> 5352 REQUEST FOR REPORT OF WASTEDISCHARGE, MUNN AND PERKINS A GGREGA TE <br /> FACILITY, ESCALON, SAN JOA Q UIN CO UNTY <br /> On 17 August 2005, Regional Board reviewed California Environmental Quality Act (CEQA) <br /> a <br /> documents related to new excavation areas for the Munn and Perkins aggregate washing facility. <br /> While reviewing the existing Waste Discharge Requirements (WDRs) for the facility it was apparent to <br /> staff that the Order requires an update. Presently, the facility is regulated by WDRs Order No. 72-022. <br /> The update is required because: <br /> • The Order is overdue for an update. California Water Code Section 13263(c) states: Upon <br /> application by any affected person, or on its own motion, the regional board may review and <br /> revise requirements. All requirements shall be reviewed periodically. Because WDRs Order No. <br /> 72-022 was prepared in the year 1972, it is not consistent withrequirements included in recently <br /> adopted orders. <br /> • An Internet search of"Munn and Perkins" reveals ownership has changed. Dischargers are <br /> required to notify the Regional Board upon change of ownership. <br /> • The apparent expansion of excavation areas may indicate a change in the operation of the facility <br /> and/or an increase of wastewater flow. <br /> Munn and Perkins is required to submit a Report of Waste Discharge (RWD)to update the WDRs. To <br /> initiate the WDR process, please submit an RWD. The RWD consists of the enclosed Form 200 and a <br /> technical report that will serve as your response to Sections VI and VIl of Form 200. The technical <br /> report must, at a minimum, address all items listed on the enclosed sheet entitled "Additional <br /> Information Requirements" and must be prepared under the supervision of a California Registered <br /> Engineer or Engineering Geologist familiar with wastewater processes. The RWD shall also include <br /> any additional information required to explain the site specific processes.
