Apr 11 03 01 : 09p ssilo 209-824-0:JJo p• .a J The Contractor shall submit a Warrantee Surety in the amount of ten percent (I0%)prior to the District's Board of Directors accepting the WORK UNIT. The Warrantee Surety shall run for 12 months(from the time the District records a"Notice of Completion")or for such longer period as provided by law Any form of Surety shall provide that no change, ez_e-sion of time,alteration,or addition to the terms of the AGREEMENT,or the WORK to be performed thereunder,orthePLANS and DRAWINGS and STANDARD SPECIFICATIONS shall in any wise affect its obligation on the surety, and the Surety waives notice thereof. If, in the opinion of the DISTRICT, defective equipment, materials, or supplies creates a dangerous condition or requires immediate correction or attention to prevent further loss to the DISTRICT or to prevent intemtption of operations of the DISTRICT, the DISTRICT will attempt to give the notice required by this article. If the OWNER cannot be contacted or does not comply with the DISTRICTS request for correction within a reasonable time as determined by the DISTRICT,the DISTRICT may,notwithstanding the provisions of this article,proceed to make such correction or provide such attention;and the costs of such correction or attention shall be charged against the OWNER. Such action by the DISTRICT will not relieve the OWNER of the guarantees required by this article or elsewhere in the AGREE-MEN'T or STANDARD SPECIFICATIONS. This article does not in anyway limit the guarantee on any items for which a longer guarantee is specified or any items for which a manufacturer or supplier gives a guarantee for a longer period. The OWNER agrees to act as a co-guarantor with such manufacturer or supplier and shall furnish the DISTRICT all appropriate guarantee or warranty certificates upou completion of the WORK UNIT. No guarantee period whether provided for in this article or els,-where shall in any way limit the liability of OWNER or his sureties or insurers under the indrntnity or insurance provisions of this AGREEMENT. 1-6 TIME FOR COMPLETION AND DAMAGES DUE TO DELAY The OWNER shall complete all or any designated portion of the WORK UNIT called for under this AGREEMENT within the time set forth on the PLANS and DRAWTVGS or STANDARD SPECIFICATIONS.
