Apr 11 03 01: 11p SSJID 209-acq-Uaa� r • • <br /> and further agrees that neither he nor any person, firm, or corporation furnishing any <br /> equipment, material, supplies,or labor for the WORK UNIT covered by this AGREEMENT <br /> shall have any right to a lien upon anything furnished or the premises where anything furnished <br /> is installed. <br /> 1-14 TERMINATION FOR BREACH <br /> If the OWNER refuses or fails to prosecute the WORK UNIT or any separable part thereof <br /> with such diligence as will ensure its completion within the time specified herein, or any <br /> extension thereof, or fails to complete such WORK within such time, or if he or any of his <br /> CONTRACTORS,should violate any oftheprovisions ofthis AGREEMENT,the DISTRICT <br /> may,without prejudice to any other right or remedy, serve written notice upon the OWNER, <br /> his CONTRACTOR and any Surety of the DISTRicrs intention to terminate this <br /> AGREEMENT,and unless within ten days of xr the service of such notice such violations shall <br /> cease and satisfactory arrangements for the corrections thereof be made, this AGREEMENT <br /> shall upon the expiration of said ten days cease and terminate. <br /> In the event of any such termination, the DISTRICT may take over the WORK UNIT and <br /> prosecute the same to completion by contrail or by any other method it may deem advisable <br /> for the account and at the expense of the OWNER, and any Surety shall be liable to the <br /> DISTRICT for any excess cost or other damage occasioned the DISTRICT thereby,and in such <br /> event the DISTRICT may, without liability for so doing, take possession of any equipment, <br /> materials, or supplies furnished or in transit For any portion of such WORK UNIT that the <br /> DISTRICT elects to complete by furnishing its own employees, materials, tools, and <br /> equipment, the DISTRICT shall be compensated, by OWNER, for completing such WORK <br /> UNIT. <br /> The foregoing provisions are in addition to and not in limitation of any other rights or remedies <br /> available to the DISTRICT. <br /> Development Agreement 15 of 21 <br />
