Rond Road,Lodi) <br /> On June 14,and 15,2004,you and I discussed the May 18,2004 letter from RWCQB to Leen <br /> DeSnayer,the environmental review of the above application and the permit process for the <br /> expansion of a Dairy. This letter is written at your request to memorialize those telephone <br /> conversations. <br /> A dairy may be conditionally permitted in the agricultural zones with an approved Site Approval <br /> application(Development Title Section 9-605.2 and Table 9-605.2). Site Approvals are <br /> discretionary and subject to CEQA. A dairy Site Approval does not typically place a limit on the <br /> number of cows. However,the number of cows may be limited by the manure management plan <br /> required by the Department of Environmental Health,or by regulations of the RWQCB. The <br /> number of cows may be increased at a later date without revising the approved Site Approval <br /> application. However,if the dairy expansion involves increasing the floor area of the milking <br /> parlor by more than 25%, a new Site Approval application will be required. As with the original <br /> Site Approval application,a subsequent Site Approval application for expansion of the milking <br /> parlor will not directly limit the number of cows. The following is the Special Use Regulation for <br /> Dairies in the agricultural zones: <br /> Development Title Section 9-605.6 <br /> (k) Dairies. Dairies shall be subject o the following requirements: <br /> (1) An existing or reactivated dairy may be expanded provided the <br /> expansion involves less than a twenty-five percent(25%) increase in the floor <br /> area of the milking parlor or milk house. <br /> (2) An inactive dairy may be reactivated provided said dairy has been under <br /> permit with the Environmental Health Division within the previous five(5)years <br /> of its proposed reactivation date. <br /> (3) An approve Site Approval shall be required for any expansion or <br /> reactivation of a dairy that does not comply with Subsections(k) (1)and(k)(2). <br /> (4) An approved manure management plan, as approved by the <br /> Environmental Health Division,shall be required of all dairies. <br />
