Rond Road <br /> Lodi, CA. 95242 <br /> REPORT OF WASTE DISCHARGE FOR THE DE SNAYER DAIRY, 23243 N. ROND ROAD, LODI, CA, <br /> SAN JOAQUIN COUNTY <br /> On 7 May 2004, Regional Board staff received your Report of Waste Discharge (ROWD) with the filing <br /> fee and technical information for the expansion of the De Snayer Dairy in San Joaquin County. <br /> The ROWD adequately described the project, which consists of a new milk barn and the expansion of <br /> animals at the dairy. The dairy currently milks 1,100 cows and wants to expand to 1,800 cows. The <br /> ROWD contained sufficient information regarding the wastewater generation, storage, and cropland <br /> application. The waste storage ponds have adequate capacity to store 180 days of wastewater generated, <br /> rainfall runoff, and one 25-year, 24-hour storm event. A nutrient management plan was also provided to <br /> document the application of liquid and solid manure to the cropland at the dairy site. The Report of <br /> Waste Discharge was thorough and adequately described the project and, therefore, is complete. <br /> The ROWD also included a notice of determination and negative declaration prepared by San Joaquin <br /> County Community Development Department. However, in "Appendix 2", of the ROWD the <br /> environmental document produced by San Joaquin County states that: <br /> Site Approval No. PA-03-429 of Leen De Snayer- for• a 12,960 square foot milking parlor (8,000 <br /> gallons). Located on the west side of Rond Road, 2,000 feet north of Peltier Road, south of Thornton. <br /> The San Joaquin County environmental document project statement is significantly different than what <br /> was described in the ROWD. The Conditional Use Permit was for construction of a milk barn and did <br /> not include the expansion of animals at the dairy. Therefore, the environmental document produced by <br /> San Joaquin County does not address the project, as presented in the ROWD. <br /> Be advised that the Board is unable develop requirements until the expansion of the project receives full <br /> CEQA evaluation. The applicant may not discharge additional manure or wastewater from the expanded <br /> dairy facilities in violation of Section 13264 of the California Water Code. In addition, the Regional <br /> Board cannot adopt requirements until CEQA is satisfied. Section 13264 of the California Water Code <br /> states, in part: <br /> (a) No person shall initiate any n")discharge of waste or make any material changes in any <br /> discharge, or initiate a discharge to, make any material changes in a discharge to, or- <br /> construct, an injection well,prior to the filing of the report required by Section 13260 and no <br /> California Environmental Protection Agencv <br /> Ca Recycled Pope?- <br />
