Responsible Mitigation Measures and Statements of Findings of Impacts Being Monitoring/ RespMonitoring/Reporting <br /> Significant and Unavoidable Reporting Action Party for Providing Responsibility Timing <br /> Mitigation <br /> pertaining to the burrowing owl are discussed in Mitigation Measure BIO-ib <br /> above. Measures specifically pertaining to the bats are discussed In <br /> Mitigation Measure BIO-id below. <br /> 2. Surveys shall be conducted no more than 15 days prior to the potential <br /> disturbance. <br /> 3. If active nests(eggs/chicks present)are found during pre-construction <br /> surveys,the applicant shall establish a no-disturbance buffer(acceptable in <br /> size to the CDFG)around active raptor nests and nests of other special- <br /> status birds during the breeding season,or until it is determined that all <br /> young have fledged.Typical buffers are 300 to 500 feet for raptors and 100 <br /> to 250 feet for other nesting birds.The size of these buffer zones and the <br /> types of ground-disturbing activities restricted in these areas may be further <br /> modified during coordination with the CDFG and shall be based on existing <br /> noise and human disturbance levels at the project area. Nests initiated <br /> during construction are presumed to be unaffected,and no buffer would be <br /> necessary.If pre-construction surveys indicate that nests are Inactive or <br /> potential habitat is unoccupied during the construction period,nesting <br /> substrate(i.e.,trees,shrubs,and buildings)in this area can be removed, <br /> and no further mitigation is required. Depending on the species involved, <br /> input from the CDFG and/or the U.S. Fish and Wildlife Service(USFWS) <br /> Division of Migratory Bird Management may be warranted.As <br /> recommended by the biologist, no activities shall be conducted within the <br /> no-work buffer zone that could disrupt bird breeding. <br /> 4.6 Biological Resources(cont.) <br /> 4. If there is a break of at least five days in construction activities during the <br /> nesting season,an additional nesting bird survey shall be conducted to <br /> ensure that no birds have occupied nests during the pause in construction <br /> activity. <br /> 5. Outside of the breeding season(August 31—January 31),or after young <br /> birds have fledged,as determined by the biologist,work activities may <br /> proceed. <br /> BI0-1d:Bat-Specific Avoidance Measures.Pre-construction surveys Verification by County. Union Pacific San Joaquin County No more than 15 days prior <br /> conducted by a qualified bat biologist4 shall be conducted on the project site Community Development to ground disturbing <br /> prior to construction as proposed in Mitigation Measure BIO-1c. Department activities <br /> 1. Removal of trees showing evidence of bat activity shall occur during the <br /> period least likely to affect the bats as determined by a qualified bat <br /> biologist(generally between February 15 and October 15 for winter <br /> hibernacula and between August 15 and April 15 for maternity roosts). <br /> 2. If active day or night roosts are found,the bat biologist shall take actions to <br /> make such roosts unsuitable habitat prior to tree removal. <br /> 3.A no-disturbance buffer shall be created around active bat roosts being <br /> used for maternity or hibernation purposes at a distance to be determined in <br /> 4 A qualified biologist holds an MOA with CDFG to handle bats. <br />
