Recommendations Action It is recommended that the Planning Commission: 1. Approve the Negative Declaration; and 2. Approve Use Permit No. UP-94-13 with the Findings and Conditions of Approval contained in the staff report. Findings 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan and any applicable Specific Plan or Special Purpose Plan. • This finding can be made because the proposed kennel is a conditionally permitted use in the AG-40 zone, which is an implementing zone of the General Agriculture General Plan designation. 2. Adequate utilities, roadway improvements,sanitation,water supply, drainage,and other necessary facilities have been provided, and the proposed improvements are properly related to existing and proposed roadways. • This finding can be made because the site has access to Thornton Road via an existing easement. Adequate area exists for water, storm drainage, and sewage disposal, which are to be provided by on-site well, retention ponds, and an on-site septic system. 3. The site is physically suitable for the type of development and for the intensity of development. • This finding can be made because the site plan, along with the recommended conditions of approval,will ensure that all code requirements and other standards will be met. 4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare or be injurious to the property or improvements of adjacent properties. • This finding can be made because the Initial Study prepared for this item found no potentially significant environmental impacts. 5. The use is compatible with adjoining land uses. • This finding can be met because this use will not conflict with the adjacent agricultural uses or the adjacent dog kennel.
